NRW Endorses Amendment to State Planning Law

NRW's amendment to the State Planning Law now allows district governments to suspend approval procedures for wind energy projects. The LEE NRW is anticipating a decree from the NRW Ministry of Economy which should dictate that such a suspension should only occur in individual cases.


The NRW state parliament has endorsed the amendment to the State Planning Law. District governments now possess the power to suspend approval processes for wind energy projects until the ongoing regional plan changes conclude - a state of limbo likely to endure until the end of 2025. Earlier in February, the Higher Administrative Court of NRW had similarly classified a formulation in the state development plan as evidently illegal.


"We believe, along with numerous experts, that the new regulation in the State Planning Law is blatantly illegal. Furthermore, the regulation lacks normative and legal clarity," stated Hans-Josef Vogel, Chairman of the State Association for Renewable Energies (LEE NRW). "Government factions thereby threaten their own mission of erecting an additional 1,000 new wind energy facilities by spring 2027, the end of this legislative period." Attempts by the opposition to scrap the so-called "interim regulation" through an amendment proposal proved unsuccessful.


The Chairman of LEE NRW had previously criticised this interim regulation's potential role as an impediment during an expert consultation in early May. Political leaders seem to have taken heed of this criticism. The NRW Ministry of Economy recently announced a decree that should, on the one hand, specify that a deferral for new wind energy facilities should only materialize in individual cases, and district governments should provide a comprehensible rationale for their decisions. In addition, the decree stipulates that wind energy projects planned in consultation with corresponding municipalities are exempt from potential deferments.


Amendment to the State Planning Law Unjustifiably Complicates Matters

"With this decree, the state government may have found a last-minute viable solution to prevent nationwide wind energy development from spiraling down," Vogel stated. "Incorporating the interim regulation into the new State Planning Law has needlessly and inexplicably complicated matters for the state government."


LEE NRW expects all five district governments to consider § 2 of the Renewable Energies Act (EEG) in potential suspension decisions. According to this stipulation, renewable energies - including wind energy - trump other public interests and have clear preferential consideration. "North Rhine-Westphalia's industry needs affordable green power. This is only achievable with a committed expansion of wind energy. Instead of unnecessary bureaucracy, all parties involved in municipalities, approval authorities, and the wind industry need legal security," Vogel concluded.
